Exemption from liability
1. Online services
The author will not bear responsibility for updated status,
accuracy, completeness or quality of information provided.
Liability claims on the author for damage or loss of whatever
kind as may be caused by use or non-use of information provided
or by use of faulty and incomplete information shall be excluded
as a matter of principle, unless evidence is produced to the
author’s premeditated failure or gross negligence.
All offers are subject to change without notice. The author
will explicitly reserve the right to modify or amend or delete
parts of pages or the entire programme without notice or to
discontinue publication temporarily or definitely.
2. References and links
For direct or indirect references to other authors’
web-sites (“hyperlinks”), beyond this author’s
responsibility, liability shall apply only to a situation
in which this author had knowledge of the content presented
and had been technically and reasonably in a position to prevent
its illegal use. It is explicitly stated by the author that
no illegal content had been detectable in the linked pages
at the time of link setting. The author has no influence whatsoever
on current and future content items or on the authorship of
linked pages. The author, therefore, disavows and dissociates
from any content of any linked page which may have been changed
after link setting. Such disavowal and dissociation shall
apply to all links and references set within the author’s
internet presentation, entries made by third parties in the
author’s guest books, discussion platforms, link directories,
mailing lists and any other kind of database accessible to
external users. Liability for illegal, erroneous or incomplete
items, in particular for damage caused by use or non-use of
such information shall be exclusivelyborne by the provider
of the page to which reference was made rather than by the
person who set links for such reference.
3. Copyright and labelling
The author is persistent in all publications to comply with
copyright provisions of graphs, sound documents, video sequences
and texts. The author is generally trying to use his own graphs,
sound documents, video sequences and texts or to resort to
graphs, sound documents, video sequences and texts for which
no license fees are due.
All brand names and trademarks protected by third parties
and mentioned in an internet presentation are fully subject
to the applicable labelling provisions and proprietary rights
of the registered owner. Mere verbal quotation shall not support
the conclusion that the trademark or label concerned was not
protected by rights of third parties. The copyright for items
produced and published by the author of a page shall be solely
retained by the latter. Reproduction or other use of such
graphs, sound documents, video sequences and texts in any
other electronic or printed publication shall be inadmissible
without explicit permission by the author.
4. Data protection
Entries of personal or business-related data (e-mail or postal
addresses, names etc.) to an internet presentation providing
space for such entries shall be made by the user on an absolutely
voluntary basis. Utilisation of and payment for services offered
shall be permissible without disclosure of such data or with
quotation of anonymised data or use of a pseudonym to the
extent to which such practice is technically and reasonably
feasible and acceptable. Use by third parties of contact data
given in the imprint or otherwise, including mail addresses,
phone, fax or e-mail, shall not be permissible for sending
of information that had not been explicitly asked for. Legal
action shall be reserved against any sender of so-called spam
mail or persons violating anti-spam regulations.
5. Legal effectiveness of this exemption from liability
This exemption from liability shall be deemed an integral
component of the internet presentation from which reference
was made to this page. Should any part or formulation of this
text become partially or fully invalid in terms of updated
law, the other parts of the document shall retain their validity.
